Premises Liability/Slip and Fall
Premises liability, or what is commonly referred to as “slip and fall” cases, involve injuries received when you are on someone else’s property. Property owners, whether they are individuals or businesses such as department stores and hotels, have a duty to keep their property safe for customers, visitors and pedestrians and if there is a danger on the property, properly and effectively warn of the possible dangers. Typically, these matters involve situations where a person “slips and falls” on a property owned by someone else due to a defective or dangerous condition on the property which was not properly warned about leading to an injury.
Typical examples of premises liability cases include:
- Falls due to slippery or wet floors from water, snow or ice which are not warned about;
- Trips and falls to due uneven walkway or stairs;
- Drownings in pools;
- Products falling off shelves in stores.
The property owner is not responsible simply because you sustained an injury on his property. The property owner must have been at fault or negligent with regard to the dangerous condition on the property. To recover you must also prove that the dangerous condition was not open and obvious to you such that you should have been able to avoid the dangerous condition. Proving such a case depends a lot on what the premises was like at the time you were injured, which can be changed quickly by the property owner.
